Terms of Service
GenbaShare
These Terms of Service ("Terms") govern the use of "GenbaShare" (the "Service") provided by Sanki Co., Ltd. and Ken Furuta (37design) (collectively, "we"). By using the Service, the user ("you") agrees to be bound by these Terms.
1. Service Overview
- Name: GenbaShare
- Form: Business SaaS (Software as a Service)
- Provider: Independently developed and operated by Ken Furuta (37design), with sponsorship from Sanki Co., Ltd.
- Core features: Sharing of work-site photographs and information within an organization, PDF report generation, and tenant-based data management.
2. Eligibility
- The Service is intended for businesses, or individuals acting on behalf of a business, who are at least 18 years old.
- Persons affiliated with antisocial forces, or those previously suspended for violating these Terms, may not use the Service.
3. Accounts
- You must provide accurate and current information when registering.
- You are responsible for managing your account credentials and for any activity that occurs under your account.
- Maintaining multiple accounts per individual is prohibited as a rule.
4. Prohibited Conduct
You agree not to engage in any of the following while using the Service.
- Reverse engineering, decompiling, or disassembling the Service.
- Posting or sharing confidential information of any third party without authorization.
- Posting child pornography or any other illegal images or content.
- Infringing the intellectual property, privacy, or portrait rights of any third party.
- Placing excessive load on the Service's servers or network.
- Unauthorized access, hacking, or any conduct that compromises security.
- Using the Service for any illegal activity or activity contrary to public order and morals.
- Impersonating us or any third party.
- Reselling or commercially exploiting the Service in a manner not approved by us.
5. Intellectual Property
- Ownership and copyright in user-uploaded photos, text, and other content remain with the user or the rightful owner.
- You grant us a royalty-free license to use such content to the extent necessary to operate, maintain, and improve the Service (including backups, thumbnail generation, PDF rendering, and inter-server transfer).
- All intellectual property rights in the Service itself (software, design, logos, documentation, etc.) belong to us or the rightful owners.
6. Fees
- Phase 1 of the Service is offered free of charge.
- If we introduce paid plans in the future, we will notify users in advance and apply such plans only with the user's consent.
- Pricing, payment methods, and billing cycles for paid plans will be defined in a separate pricing schedule.
7. Termination
- You may delete your account and terminate use of the Service at any time from the in-app settings or the Service website.
- Deletion is effective immediately, and account information and site-record data will be physically deleted within 30 days as a rule.
- We may suspend or delete an account without prior notice if the user breaches these Terms.
8. Disclaimer
- The Service is provided "as is." We make no warranty of any kind, including completeness, accuracy, usefulness, or fitness for a particular purpose.
- We are not liable for any damages incurred by users or third parties as a result of business use of the Service, including estimation errors, construction mistakes, or lost opportunities.
- We are not liable for damages caused by system outages, communication failures, force majeure, or other events outside our reasonable control.
- Where we are nevertheless found liable, our aggregate liability is capped at the amount you paid for the Service in the month the damage occurred (zero for free plans).
9. Changes to Terms
We may revise these Terms as needed. Material changes will be announced in advance on the Service website or in the application. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
10. Governing Law and Jurisdiction
- These Terms are governed by the laws of Japan.
- Any disputes arising out of or relating to the Service shall be subject to the exclusive jurisdiction of the Osaka District Court of Japan as the court of first instance.
